Terms of Service for Electronic Services

§ 1. General Provisions

1. These Terms of Service define the rules and conditions for using the online platform available at https://oraculoo.com (hereinafter referred to as the 'Service'), as well as the rights and obligations of the Service Provider, Clients (Users), and Experts (Tarot Therapists and Mages).
2. The Service is operated by Fenix Trading sp. z o.o. based in Skrzeszew.
3. Every person is obliged to read these Terms of Service before using the Service. Registration in the Service or using paid services implies full acceptance of its provisions.
4. The Service provides entertainment, advisory, and esoteric services. All materials, analyses, and advice generated automatically or provided by Experts do not constitute medical, legal, financial, or psychological advice within the meaning of generally applicable laws.

§ 2. Definitions

• Service (Application) – the online platform operating at https://oraculoo.com.
• Service Provider (Operator) – Fenix Trading sp. z o.o., NIP: PL5272939283, KRS: 0000864665.
• Client (User) – a natural person with full legal capacity who uses the services offered by the Service.
• Expert (Tarologist / Mage) – a natural person or business entity providing esoteric, fortune-telling, or ritual services to Clients through the Service.
• Account – an individual profile of a User or Expert in the Service, protected by a password.
• Subscription – a subscription service for Clients, guaranteeing cyclical access to specific sets of functionalities in exchange for a regular periodic fee.

§ 3. Types and Scope of Provided Services

1. Services for Clients (Users):

• Daily tarot card reading – a free service available to every visitor to the Service without the need for registration.
• Weekly tarot card reading – a free service requiring registration and creating an Account in the Service.
• Creation of magic talismans (for luck, health, love, money) – a paid service consisting of the digital or physical preparation of a personalized talisman.
• Chat with a professional Tarologist – a service paid in real-time or per message. The Service Provider acts solely as a technological and billing mediator between the Client and the Tarologist.
• Ordering a magic service (ritual) from a professional Mage – a service paid on a one-time basis. The Service Provider acts solely as an intermediary connecting the parties.

2. Services for Experts (Tarologists and Mages):

• Opportunity to conduct paid Chat with Service Users to provide fortune-telling services.
• Opportunity to add and offer their own personalized magic services and rituals for Users through the Service catalog.

§ 4. User Subscription

1. A User can purchase a paid Subscription in the Service. Within the Subscription, the User cyclically receives:
   • Automatic delivery of dedicated daily and weekly predictions directly to the specified communication channel (e.g., e-mail / user panel).
   • Once a month, a discount equivalent to 10 EUR for a question asked to a Tarologist in Chat. The discount cannot be exchanged for cash and expires at the end of the given billing period.
   • Once a month, a free magic talisman (selected from the available subscription catalog).
2. The Subscription fee is automatically charged at the beginning of each billing period from the User's payment card. Transaction rejection results in the suspension of access to the subscription account.

§ 5. Pricing, Commissions, and Financial Settlements

1. All prices in the Service for Clients are clearly specified next to individual paid services and include due taxes (including VAT, if applicable).
2. Client Transaction Commission: The Service adds or charges a commission of 25% of the gross transaction value on payments made by Clients for individual services (chat, rituals).
3. Expert Withdrawal Commission: The Service charges a commission of 10% of the amount withdrawn by Mages and Tarologists from their virtual wallet in the Service to their bank account. Withdrawals are processed at the Expert's request within the timeframes specified in the partner panel.
4. Payments are processed through certified online payment integrators. The Operator does not store full payment card details.

§ 6. Rights and Obligations of Experts and the Role of the Service

1. Fenix Trading sp. z o.o. declares that it provides the ICT infrastructure and is not a party to the contract for the provision of esoteric/ritual services concluded between the Client and the Expert. The responsibility for the substantive content of chat responses and the proper execution of rituals lies solely with the Expert.
2. The Expert undertakes to perform services reliably, maintain full confidentiality of the Client's data, and respect the prohibition on providing private contact details outside the Service under penalty of immediate account blocking.

§ 7. Liability and Complaints

1. Complaints regarding the operation of the Service and services provided directly by the Operator should be submitted electronically to the address: kontakt@oraculoo.com.
2. Complaints are processed within 14 days from the date of receipt. The response is sent to the User's e-mail address.
3. Given the specific nature of esoteric services, the Operator does not guarantee the accuracy of predictions or any effects of a supernatural/magic nature. The Client uses the services at their own risk.

§ 8. Final Provisions

1. In matters not regulated by these Terms of Service, the provisions of the Civil Code and the Act on the Provision of Electronic Services apply.
2. The competent court for resolving disputes is the court competent for the seat of the Service Provider.
